This privacy policy ("policy") will help you understand how LHM Medical Technology (UK) Ltd. (“LHM Medical”, “we”, “our”, or “us”) collects, uses and protects the data you provide to us when you visit and use (website), including any data when you register for an account or make an enquiry via our website. This policy applies regardless of where you visit the website from.

We keep our privacy policy under regular review. This version was last updated in February 2021.  Historic versions can be accessed by contacting us.

It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.

GDPR is an EU-wide privacy and data protection law that regulates how EU resident’s data is protected by companies and enhances the control the control the EU residents have, over their personal data.

The GDPR is relevant to any globally operating company and not just the EU-based businesses and EU residents. Our customer’s data is important irrespective of where they are located, which is why we have implemented GDPR controls as our baseline standard of all our operations worldwide.

The website is not intended for children and we do not knowingly collect data relating to children.

What user data we collect

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data). We may collect, use, store and transfer different kinds of personal data about you.

When you visit the website, we may collect the following data:

We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

How is your data collected?

We use different methods to collect data from and about you including through:

  • Direct interactions. You may give us your personal data when you register for an account, make an enquiry or fill in any other forms or make any other request via the website.

  • Automated technologies or interactions. As you interact with our website, we will automatically collect technical data about your equipment, browsing actions and patterns.   • Third parties or publicly available sources. We will receive personal data about you from various third parties and public sources such as technical data from analytics providers such as Google, advertising networks and search information providers.

  • Contact, Financial and Transaction Data. We may receive data from providers of technical, payment and delivery services and identity and contact data from publicly available sources such as Companies House and the Electoral Register based inside the UK.

Why we collect your data

We will only use your personal data when the law allows us to. We collect and process your data for several reasons:

• to fulfil your order or contract, and to get in touch with you to fulfil any enquiry you make to us via the website;   

• to improve our services and products generally, and where it is necessary for our legitimate interests (or those of a third party) and your interests and rights do not override those interests;

• to send you promotional emails regarding our products and services only, which is necessary for our legitimate interests (to study how customers use our products/services, to develop them, to grow our business and to inform our marketing strategy);

• to contact you to fill out surveys and participate in other types of market research which is necessary for our legitimate interests to study how customers use our products/services;

LHM Medical is committed to securing your data and keeping it confidential. LHM Medical has put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

When you are filling the forms on the website, make sure to check if there is a box which you can leave unchecked, if you don't want to disclose your personal information.

Please note that we may process your personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

We will get your express opt-in consent before we share your personal data with any third party for marketing purposes.

Disclosures of personal data

We may share your personal data with third parties to whom we may choose to sell, transfer or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy policy.

We may share your personal data with third party service providers, in particular with any CRM and marketing provider.  We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

Where a third party service provider hosts data on servers outside of the UK, we will only transfer your personal data outside of the UK where we can ensure a similar degree of protection is afforded to it by ensuring that the country has been deemed to provide an adequate level of protection for personal data, or where the contract with the service provider gives the personal data the same protection as it has in the UK.

How long will you use my personal data for?

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

By law we have to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for six years after they cease being customers.

In some circumstances we will anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

Your legal rights

Under certain circumstances, you have rights under data protection laws in relation to your personal data. These include rights of correction, requests to erasure, and objections or restrictions on processing. You may also request a transfer of your personal data.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights).

However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
